This Site is offered to you conditioned on your acceptance without modification of the terms, conditions, and notices contained herein (the "Terms"). Your use of the Site constitutes your agreement to all such Terms. Please read these terms carefully, and keep a copy of them for your reference. The Site is an E-Commerce Site.

PRIVACY POLICY

We will treat all your personal information as confidential and will only use it in accordance with our Privacy Policy. Your use of www.generationsskincare.net is subject to Generations Skincare's Privacy Policy. Please review our Privacy Policy, which also governs the Site and informs users of our data collection practices. Electronic Communications Visiting the Site or sending emails to Generations Skincare constitutes electronic communications.

TERMS OF SALE

The following terms of sale apply to orders placed through this Site:

1) Processing:All orders shall be subject to the terms of these Terms and Conditions. We reserve the right to cancel any orders that do not contain a valid address.

2) Pricing: All prices shown on the website are exclusive of Sales Tax and Shipping charges. We reserve the right to change prices at any time without notice to you. Payment can be made by any major credit card, your PayPal account, or ApplePay. Payment will be debited and cleared from your account before shipment of your order to you. In the unlikely event that the price shown on the checkout page is wrong and we discover this before accepting your order, we are not required to sell the product to you at the price shown. We always try to ensure that the prices of products shown on The Site are accurate, but occasionally genuine errors may occur. If we discover an error in the price of products that you have ordered, we will let you know as soon as possible and give you the option of reconfirming your order at the current price or cancelling it. If you cancel your order and you have already paid for the product, then you will receive a full refund.

3) Payment:You confirm that the credit card, PayPal, or Apple Pay Account being used is yours. If the issuer of your payment card refuses to or does not, for any reason, authorize payment to us, we will not be liable to you for any delay or non-delivery. If your credit or debit card payment is not processed successfully for any reason, we reserve the right to attempt to process payment again within 48 hours. In the event that the payment is still not successful, we will give you at least 48 hours’ notice in advance of any further attempt to process payment by sending an email to the email address you have provided to us. If you do not want us to reattempt to process payment, you must cancel your order in advance.

4) Discount Codes:You may use only one discount code with each order. We reserve the right to any reject orders if you add more than one discount code to the order. We allow you to use discount codes based on the terms and conditions upon which they were issued, which may include terms relating to your eligibility and the value of the order.

5) Shipping and Delivery:Free US Shipping on Orders over $69. If the order is less than $69, customer will pay $8.30 shipping fee. We ship via US Postal Priority Mail Service to all 50 states. We reserve the right to change this policy at any time. Currently we only ship to US-based customers. Please assume one week of processing and transit time from the time of your order to receiving your package. Generations Skincare will not be responsible for any delays in delivery which are beyond our control.

6) Returns:If you are not satisfied with your order and would like to return the product, please follow our Return Policy which can be found at: Returns Policy.

7) Fraud:In order to protect you and Generations Skincare from fraudulent transactions, we may provide your transaction-related information to a reputable third-party organization to perform an address verification to ensure that the "bill to" address that you provide matches your credit card address. Generations Skincare reserves the right, at its discretion, not to ship items ordered on the Site to certain addresses.

8)Children Under Thirteen:Generations Skincare does not knowingly collect, either online or offline, personal information from persons under the age of thirteen. If you are under 18, you may use the Site only with permission of a parent or guardian.

9) International Users:The Service is controlled, operated and administered by Generations Skincare from our offices within the USA. If you access the Service from a location outside the USA, you are responsible for compliance with all local laws. You agree that you will not use the Generations Skincare Content accessed through The Site in any country or in any manner prohibited by any applicable laws, restrictions or regulations. 

ACCURACY OF PRODUCT INFORMATION

When describing our products on the Site, we try to be as accurate as possible, however, we do not warrant that the product description details including: product Availability, size, color, price, packaging, or other product and program descriptions are without error, current, accurate, complete, or reliable. Customers have the option to return the item per our return policy, if a product or program offered on the Site is not as described. Products displayed on the Site can only be ordered and delivered within the United States. All prices displayed on the Site are quoted in U.S. dollars and are valid only in the U.S. Product material and information presented on the Site is intended solely for personal and informational purposes. 

INTELLECTUAL PROPERTY

All information and content available on the Site and its overall appearance, including but not limited to trademarks, logos, service marks, text, graphics, logos, button icons, images, audio clips, data compilations and software, and the compilation and organization thereof (collectively, the "Content") is the property of Generations Skincare, including laws governing copyrights and trademarks. As a condition of your use of the Site, you warrant to Generations Skincare that you will not use the Site for any purpose that is unlawful or prohibited by these Terms. You may not use the Site in any manner which could damage, disable, overburden, or impair the Site or interfere with any other party's use and enjoyment of the Site. 

LIMITED LICENSES

You are granted a non-exclusive non-transferable, revocable license to access and use the Site strictly in accordance with these terms of use. You agree that you do not acquire any ownership rights in any protected content. We do not grant you any licenses, express or implied, to the intellectual property of Generations Skincare or our licensors except as expressly authorized by these Terms. Any unauthorized use by you of the Site or any and/or all of our Content automatically terminates the limited licenses without prejudice to any other remedy provided by applicable law or these Terms and Conditions. 

YOUR RESPONSIBILITIES

In the access of use of the Site, you shall comply with these Terms and Conditions and instructions for access or use posted on the Site. You may not make any changes o the Site or any Content or services that may appear on this Site and may not impair in any way the integrity or operation of the Site. If you default willfully or negligently in any of the responsibilities set forth in these Terms and Conditions, you shall be liable for all losses and damages that this may cause to Generations Skincare.

Certain services made available via the Site are delivered by third party sites and organizations. By using any product, service or functionality originating from the Site domain, you hereby acknowledge and consent that Generations Skincare may share such information and data with any third party with whom Generations Skincare has a contractual relationship to provide the requested product, service or functionality on behalf of the Site users and customers. If you do not want information about you to be shared in this manner, do not use this feature.

CONSENT

You Consent to receive electronic communications and you agree that all agreements, notices, disclosures and other communications that we provide to you electronically, via email and on the Site, satisfy any legal requirement that such communications be in writing. We will not provide the benefits of this Site to any user who does not consent to receipt of such communication electronically.

WEBSITE PROMOTIONS

Generations Skincare may periodically offer special promotions (such as discounts or other offerings) (collectively, “promotions”). Generations Skincare will disclose details for these promotions (i.e. promotional dates, eligibility requirements, product content, etc.) when offered. If you choose to participate in a promotion, you agree that your participation may be subject to Additional Terms or other guidelines, rules, and/or policies offered by us and/or by third parties.

CUSTOMER REFERRAL PROGRAM

Subject to the terms set out below, you may earn ‘credit’ for use on this Website by referring a new customer(s) to us through our referral program by sharing the referral link and/or referral code we provide to you. You are only eligible to participate as a ‘referrer’ in this Referral Program if you have previously placed an order on the Site. A new customer is a person who has not previously placed an order with Generations Skincare (a "Referee"). If the Referee has an account on the Site, but has not previously placed an order on the Site, then they are entitled to participate in the Referral Program through the ‘referral link’ only. If the Referee already has an account and has previously placed an order on the Site, then they will be unable to participate in the Referral Program as a Referee. If the Referee has clicked through your referral link, the code for complementary product will automatically be applied at checkout. If the Referee is using a referral code, the Referee must enter this code at checkout. Any credit generated from the Referral Program may only be credited on the Site and neither you nor the Referee is entitled to receive any payment of any kind in respect of the credit. The credit is not redeemable for cash. The credit that stands to your Referral Program account is not transferable in any way. Both the Referee and Referral will receive the complementary product with their next scheduled product delivery. If the Referee cancels their order for any reason within 24 hours of it being dispatched, you will not qualify for any credit. We may, in our sole discretion, withdraw your credit generated from the Referral Program at any time if we believe or suspect that your use of the Referral Program is fraudulent or misleading to these terms.

USER CONTENT

You may not misrepresent your affiliation with a person or entity or otherwise mislead us as to the origin of any submission.

The arbitrator's award shall be final, and judgment may be entered upon it in any court having jurisdiction. In the event that any legal or equitable action, proceeding or arbitration arises out of or concerns these Terms and Conditions, the prevailing party shall be entitled to recover its costs and reasonable attorney's fees. The parties agree to arbitrate all disputes and claims in regards to these Terms and Conditions or any disputes arising as a result of these Terms and Conditions, whether directly or indirectly, including Tort claims that are a result of these Terms and Conditions. The parties agree that the Federal Arbitration Act governs the interpretation and enforcement of this provision. The entire dispute, including the scope and enforceability of this arbitration provision shall be determined by the Arbitrator. This arbitration provision shall survive the termination of these Terms and Conditions.2) Class Action Waiver: Any arbitration under these Terms and Conditions will take place on an individual basis; class arbitrations and class/representative/collective actions are not permitted. If you are not satisfied with any portion of the site, or with any of these Terms of Use, your sole and exclusive remedy is to discontinue using the Site.

TERMINATION/ACCESS RESTRICTION

Generations Skincare reserves the right, in its sole discretion, to terminate your access to the Site and the related services or any portion thereof at any time, without notice. To the maximum extent permitted by law, this agreement is governed by the laws of the State of Colorado and you hereby consent to the exclusive jurisdiction and venue of courts in Colorado in all disputes arising out of or relating to the use of the Site. A printed version of this agreement and of any notice given in electronic form shall be admissible in judicial or administrative proceedings based upon or relating to this agreement to the same extent and subject to the same conditions as other business documents and records originally generated and maintained in printed form. It is the express wish to the parties that this agreement and all related documents be written in English.

CHANGES TO TERMS

Generations Skincare reserves the right, in its sole discretion, to do any of the following without prior notice: (a) Change the terms under which the Site is offered (b) Suspend, terminate or modify the access to or operations of the Site (c) Change or modify the Site or any portion of it or the products or its programs (d) Interrupt the functions or features of the Site for maintenance or other changes.
